1. Company Information

immagenAI is a product of SIMPHONY TECHNOLOGIES GROUP SAS, NIT 901553246-6, a company incorporated under the laws of Colombia. By using the Service, you are entering into an agreement with SIMPHONY TECHNOLOGIES GROUP SAS.

2. Acceptance of Terms

By accessing or using immagenAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.

3. Description of Service

immagenAI is an AI-powered photo transformation platform. Users upload photos that are processed by artificial intelligence models to generate transformed images in various styles. The Service includes a free tier with limited transforms and watermarked output, as well as paid credit packs for higher-quality, watermark-free results.

4. User Accounts

To access paid features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years of age to use the Service.

5. User Content & Intellectual Property

You retain full ownership of all photos you upload to the Service. By uploading a photo, you grant immagenAI a limited, temporary license to process that photo solely for the purpose of generating your requested transformation. We do not claim ownership of your original photos or the transformed results.

Free tier: Transformed images on the free tier include a watermark and are intended for personal, non-commercial use only.

Paid tier: Images generated with paid credits are delivered without a watermark. You may use these images for personal or commercial purposes, provided they comply with applicable laws and do not infringe on third-party rights.

6. Payments & Credits

immagenAI offers one-time credit packs (no subscriptions). Payments are processed securely through MercadoPago. Prices are displayed in US Dollars (USD) and Colombian Pesos (COP). Credits are added to your account immediately upon successful payment and do not expire.

Refund policy: Due to the digital nature of the Service, refunds are not available for credits that have already been used. If you experience a technical issue that consumes credits without delivering a result, please contact us and we will review your case and may issue a credit restoration at our discretion. Refund requests must be submitted within 7 days of purchase.

7. Prohibited Use

You may not use the Service to process images that contain illegal content, depict minors in any inappropriate context, infringe on third-party intellectual property rights, or violate any applicable laws. You may not use the Service for deepfakes, impersonation, harassment, or any purpose that could cause harm to others. We reserve the right to terminate accounts that violate these restrictions without notice or refund.

8. Service Availability & Warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access or that AI-generated results will meet specific expectations. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

9. Limitation of Liability

To the fullest extent permitted by law, SIMPHONY TECHNOLOGIES GROUP SAS and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Colombia.
